In accordance with the provisions of the Federal Law on the Protection of Personal Data held by Private Individuals, this Privacy Notice is issued under the following terms:
DEFINITIONS: (i) Privacy notice: This document, as that term is defined in subsection I. of article 3 of the law; (ii) Law: Federal Law on the Protection of Personal Data held by Private Individuals; Regulation: Regulation of the Federal Law on the Protection of Personal Data held by Private Individuals; (iii) Controller: Yits Kaan Kamala Jiménez González.
PERSONAL DATA CONTROLLER IDENTITY AND ADDRESS: For the purpose of this Privacy Notice, Mrs. Yits Kaan Kamala Jiménez González (hereinafter the “CONTROLLER”), is indicated as the person responsible for obtaining, disclosing, storing, using, including the action of accessing, handling, transferring or making available personal data (hereinafter the “Processing”) to the Privacy Committee designated by THE CONTROLLER (hereinafter the “Privacy Committee”), domiciled at Avenida Casa Fuerte 107-6, Colonia Casa Fuerte, Tlajomulco de Zúñiga, Jalisco, C.P. 45645.
INFORMATION TO BE COLLECTED AND PURPOSES OF PERSONAL DATA PROCESSING: We inform you that THE CONTROLLER may collect your information through different sources, whether Personal and/or Directly provided by the Holder or Indirectly by any other information source commercially available or permitted by Law. The collection and Processing of the Holder’s personal data, including the sensitive personal data that we may collect, where applicable, and unless the Holder provides otherwise through the means described in this Privacy Notice, has the purpose of evaluating employment applications, hiring employees, evaluating contractors, proposals and procurement with service and product providers, preparation and handling of commercial agreements, payment processes, as well as meeting our labor, administrative, commercial and fiscal obligations, establishing provider databases, developing new products and services, advising, marketing, promotion, procurement and placement of all services and products and/or improvement of our products and services, and other obligations derived from any legal relationship between the personal data holder and THE CONTROLLER. Your personal data may also have the following purposes, among others: (I) Handling legal requirements from competent authorities; (ii) Informing them of the range of new products and services, as well as benefits, discounts, promotions, market studies, promotions, notifications about change in conditions, and in general all the publicity derived from the products and services THE CONTROLLER offers; (iii) Analysis and development of products and providers, as well as the use of our products and services; and (iv) For the fulfillment of our terms and conditions in relation to our obligations, agreements, contracts, as well as the development of products, sale of products or the rendering of our services; and (v) where applicable, for the use of our human resources and purchasing department, in accordance with the policies of the latter. The sensitive data that may be collected may be used to better fulfill our legal, fiscal or commercial objectives.
OPTIONS AND MEANS THE CONTROLLER OFFERS PERSONAL DATA HOLDERS TO LIMIT THE USE OR DISCLOSURE OF YOUR INFORMATION: The holder’s personal data shall be kept strictly confidential, in accordance with the security, administrative, technical and fiscal measures THE CONTROLLER has implemented for such purpose, and those she may implement in the future in her security policies and procedures, and its unlawful disclosure is prohibited and its use by third parties limited, in accordance with the provisions of this Privacy Notice.
MEANS FOR EXERCISING HOLDER’S RIGHTS: You have a right to know what personal data of yours we have, what we use them for and what conditions of use we give them (Access). In addition, it is your right to request the correction of your personal information if it is not up to date, inaccurate or incomplete (Rectification); that we delete it from our records or databases when it is considered that it is not being adequately used (Cancellation); as well as object to the use of your personal data for specific purposes (Opposition). Through a written request containing the following information: (I) The full name of the personal data holder, address and email account, to be able to communicate the response to your request; (ii) The documents confirming the identity and, where applicable, legal representation of the personal data holder; (iii) The clear and precise description of the personal data for which it is sought to exercise any of the aforementioned rights; (iv) In the case of personal data rectification requests, the holder must indicate the modifications to be able and contribute the documentation sustaining their request.
PERSONAL DATA TRANSFER.
THE CONTROLLER may make the data transfer to: (I) The affiliate companies of THE CONTROLLER; (ii) Third party providers of services for the fulfillment of the legal obligations acquired by THE CONTROLLER; (iii) Third party providers of services of investigation, data analysis, sending of information focused on the needs of the personal data holder, as well as the realization of other financial services necessary or required by the personal data holder; (iv) Commercial partners with whom THE CONTROLLER carries out agreements or contractors focused on the development of new products and/or services focused on improvement and according to their needs and investigation; (v) Third parties derived from a corporate restructuring, including the merger, consolidation, sale, liquidation or transfer of assets; and (vi) Other transfers provided in the aforementioned Law and its Regulation.
Third parties and entities receiving personal data assume the same obligations and/or responsibilities as THE CONTROLLER in accordance with what is described in this Privacy Notice.
A personal data holder who submits a request to establish a legal relationship with THE CONTROLLER accepts the transfer of their personal data, under the terms described in this Privacy Notice.
CHANGES TO PRIVACY NOTICE: Any change to this privacy notice will be informed to you through any of the following means: (i) Notices in any of the offices of THE CONTROLLER; (ii) Notices on the Internet portal of THE CONTROLLER (www.lenguajeglobal.com and/or www.onegloballanguage.com); and (iii) Any other means of public or private communication provided in the contracts covering the operations executed between THE CONTROLLER or by any of the companies of THE CONTROLLER.
The Privacy Notice will be at all times comprised of representatives of functional areas designated by Mrs. Yits Kaan Kamala Jiménez González.
